A lawyer must not reveal information about a client's representation without consent. This includes all information relating to the representation, regardless of the source. Exceptions exist for preventing death, serious bodily harm, or complying with court orders.
Rule 5-1.1
Trust Accounts
Client funds must be held in a separate trust account. Lawyers may not comingle personal and client funds. IOLTA accounts are required for nominal or short-term client funds. Detailed records must be maintained for 6 years.
Rule 5-1.2
Recordkeeping
Lawyers must maintain complete records of trust account funds. Monthly three-way reconciliation is required: bank statement, checkbook register, and client ledger must all agree. Records must be kept for 6 years after the representation ends.
Rule 4-7.22
Qualifying Providers
Governs lawyer referral services. Only "qualifying providers" approved by the Florida Bar may provide referrals for compensation. Avvo, Martindale-Hubbell, and FindLaw are qualifying providers. Unauthorized lead generators are prohibited.
Rule 4-5.4
Fee Splitting
Lawyers may split fees with other lawyers if: the client consents in writing, the total fee is reasonable, and the split is proportional to services or each lawyer assumes joint responsibility. Non-lawyers may not share legal fees.
Rule 4-8.4
Misconduct
A lawyer shall not engage in conduct involving dishonesty, fraud, deceit, or misrepresentation. This includes conduct that is prejudicial to the administration of justice. AI-generated content must be reviewed and verified before filing.
Rule 6-10
CLE Requirements
Florida attorneys must complete 40 CLE hours per 3-year reporting cycle. At least 5 hours must be in ethics/professionalism. Technology CLE is recommended but not currently mandatory. Failure to comply results in suspension.
